AKI - Adnkronos international Italy: Court scraps trial of US soldier over agent’s murder
Rome , 25 Oct. (AKI) - An Italian court on Thursday threw out a case against US soldier charged with shooting dead Italian intelligence agent Nicola Calipari as he accompanied a freed Italian hostage to Baghdad airport on 4 March 2005.
A Rome judge ruled that Italy had no jurisdiction in the case against Mario Lozano, 35, who had been on trial in absentia since April after the US refused to hand him over for trial.
Lozano denies any wrongdoing and had no choice but to fire at Calipari, a military intelligence (SISMI) officer, who died at a US checkpoint as he shielded reporter Giuliana Sgrena from a hail of bullets fired at their Toyota vehicle.
Defence lawyers for Lozano said an Italian court had no right to try him, as soldiers in Iraq came under the exclusive jurisdiction of their own country. The court accepted this argument.
Italian lawyer, Alberto Biffani, who was appointed to represent Lozano expressed satisfaction with the ruling.
"I was convinced my arguments were sound," he said, noting that the public prosecutor could appeal the ruling.
But others reacted angrily to the scrapping of Lozano’s trial. "They have killed Nicola for the second time - this time in the name of the Italian people," said Calipari’s wife, Rosa Villecco Calipari.
"The arrogance of America - which never wanted this trial - has won. It’s an incredible decision," said Sgrena, who attended the hearing.
"Calipari received a hero’s welcome in Italy when he came home in a coffin," she added.
A journalist with leftwing daily Il Manifesto, Sgrena was freed on 4 March 2005 after being held hostage for a month. She was wounded in the shoulder during the shooting incident.
The circumstances surrounding her release strained relations between Italy and the US.
Both agree that Lozano fired the fatal shot and that the killing was not deliberate.
But two countries drew differing conclusions over the shooting of Calipari. The US military claimed the Toyota was driving too fast, which alarmed soldiers, who feared it was an insurgent attack.
Italian officials said the car was travelling at a normal speed and accused the US military of failing to signal there was a checkpoint or to give prior warning before opening fire.

ولقد اتهم الجندي الأمريكي بإطلاق النار في شهر آذار/مارس 2005 على سيارة كان يستقلها نيكولا كاليباري لنقل الصحافية الايطالية جوليانا سغرينا والرهينة السابقة بعد أن أطلق سراحها إلى مطار بغداد ومنه إلى بلادها
ولقد اختلفت لجنة إيطالية-أمريكية عندها في تحديد الجهة المسؤولة عن الحادثة إلى درجة أنها خرجت بتقريرين منفصلين مما أحدث توترا في العلاقات الدبلوماسية بين البلدين نظرا لرفض إدارة واشنطن مثول جنديها أمام السلطات القضائية الإيطالية
واعتبرت سغرينا، التي تعمل في صحيفة يسارية، قرار المحكمة الإيطالية اليوم الخميس "انتصارا للغطرسة الأمريكية التي لم تتقبل أبدا هذه المحاكمة". وأردفت "ليس هناك رغبة لإحقاق العدالة لكاليباري، الذي أُحتفي به كبطل في حين عاد إلى بلاده داخل تابوت" وتأسفت لـ"عدم رغبة إيطاليا في معرفة حقيقة ما حدث"، على حد قولها
